Details from Civic Engagement Beyond Voting (CEBV), a grassroots nonpartisan organization:

​

In Sept 2022, Judge Kellie L. Johnson ruled that the Civil War-era abortion law, which was updated and codified in 1901, superseded the 15-week ban passed by the AZ State Legislature earlier that year.

One day before the 15-week ban was to go into effect, she seized the opportunity to lift a 1973 injunction on the 1901 law, citing the US Supreme Court's decision to reverse Roe vs. Wade.

The 1864/1901 law was subsequently repealed by the AZ State Legislature, and the AZ Supreme Court has agreed to stay enforcement until the repeal goes into effect.

PROP 139

ARIZONA ABORTION ACCESS ACT establishes a constitutional right to a safe a legal abortion under rules similar to those previously in place under Roe v. Wade.

PROP 133

Permanently prevents any non-partisan (open primary-type) elections statewide, precluding any county, city or district from using open primaries. Locks in Republican majorities in some areas.

PROP 134

Requires citizen initiative petitions to meet signature requirements in each of all 30 legislative districts to be eligible for the ballot. Impossible in very Republican and rural districts.

 

PROP 135

Automatically terminates the Governor’s emergency powers 30 days after any emergency declaration unless extended by the Legislature. Legislative power grab of executive authority.

 

PROP 136

Allows any person to bring legal action challenging a citizen initiative, even as signatures are being collected, by claiming it would violate the U.S. or AZ Constitution. Kills citizen initiatives.

 

PROP 137

Allows for life terms for AZ Supreme Court justices retroactively.

 

PROP 138

Allows employers to pay up to 25% less than the minimum wage for tipped employees.

 

PROP 140

Establishes open primaries in which all candidates run in the same election. Gives too much authority to Legislature to determine how elections are run.

 

PROP 311

Establishes a benefit of $250,000 to the surviving spouse or children of a first responder killed in the line of duty. Sounds good BUT a $20 penalty further penalizes convicted felons and is insufficient to adequately fund an ongoing benefit source.

 

PROP 312

Allows property owners to apply for a tax refund from a local government for failing to enforce some public nuisance laws on or near that person’s property. This could bankrupt local governments.

PROP 313

Inflexible punishment; may punish victims.

​

PROP 314

Allows arrest by state and local law enforcement of undocumented noncitizens and allows states judges to order deportations. This violates federal immigration authority and is unconstitutional. It also criminalizes selling foreign-source fentanyl that causes a person’s death (already a crime).

 

PROP 315

Requires state agencies implementing a regulation that would increase costs by more than $500,000 over 5 years to get approval from the Legislature first. The Arizona Corporation Commission, which oversees utilities, is not included in this. Another power grab by the Legislature of executive office authority.

Justice KING

A vote "NOT TO RETAIN" will prevent a justice from serving another judicial term and allow the governor to appoint a new justice.

 

Arizona Supreme Court Judges Clint Bolick and Kathryn King were appointed by former Republican Governor Doug Ducey. The two justices voted to revive a 

near-total abortion ban from 1864. Justices who do not protect reproductive rights should have no place on Arizona's Supreme Court.
