Justice of the Supreme Court - Retention
John Lopez IV
More info:
The 2026 Gavel Watch report from Civic Engagement Beyond Voting (CEBV) recommends voters do not retain Justice John Lopez IV, citing a consistent pattern of ideological bias in social justice and criminal justice rulings.
According to the 2026 Gavel Watch report, Justice Lopez was rated "Do Not Retain" both in 2020 and again in 2026, based on a consistent pattern of ideological bias in cases touching both social justice and criminal justice. Lopez was appointed to the Arizona Supreme Court by Gov. Doug Ducey in 2016.
The report highlights Lopez's majority opinion in Planned Parenthood v. Mayes (2024), which held that Arizona's 1864 near-total abortion ban took precedence over a 2022 15-week restriction, a decision later overridden by the 2024 constitutional amendment protecting abortion rights, passed with 61.6% of the vote. CEBV also points to his 2022 opinion denying Arizonans the right to challenge Gov. Ducey's flat tax at the ballot, his votes allowing de facto life sentences for juveniles and warrantless searches of internet activity, and his role in the 2019 Brush & Nib decision permitting a business to refuse service to same-sex customers.
